Terms of Service
Last Updated: October 7, 2026
1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Enqualia IO platform ("Platform"), available at enqualia.io. The Platform is operated by Enqualia, a sole proprietorship (eenmanszaak) registered in the Netherlands under KVK number 97480169.
By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
2. Description of Service
Enqualia IO is a SaaS platform that enables users to create, deploy, and manage custom AI-powered APIs. The Platform provides tools for API key management, usage metering, billing, and analytics to facilitate integration of AI services into third-party applications.
3. Account Registration
To use the Platform, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.
By signing up, you consent to the collection and processing of essential data required for the Platform to function, as described in our Privacy Policy. You may not create an account or use the Platform without providing this consent.
You must be at least 16 years old to create an account, or have the consent of a parent or legal guardian if you are between the applicable minimum age and 18. If you are a business client integrating the Platform's APIs into your own product whose end-users may include minors, you are responsible for obtaining any legally required parental or guardian consent for those end-users.
4. API Keys & Access
The Platform allows you to generate and manage API keys for accessing AI-powered APIs. You are solely responsible for the security and proper use of your API keys. Any activity that occurs through your API keys is your responsibility.
You must not share API keys with unauthorized parties, use them for any unlawful purpose, or attempt to circumvent usage limits or access controls.
5. Billing & Payment
Usage of the Platform is subject to fees based on your API consumption and selected plan. You are responsible for all charges incurred under your account.
Access to certain APIs may be provided at no cost when you are a member of a team project where another user is the owner responsible for billing. In such cases, the project owner bears responsibility for all associated costs.
Failure to pay outstanding fees may result in suspension or restriction of access to the Platform and its services.
6. Acceptable Use
You agree not to:
- Use the Platform for any illegal, harmful, or fraudulent activity.
- Attempt to reverse-engineer, decompile, or extract the source code of the Platform or its APIs.
- Interfere with or disrupt the integrity or performance of the Platform.
- Use the Platform to transmit malware, spam, or other malicious content.
- Resell or redistribute access to the Platform without prior written permission from Enqualia.
- Exceed rate limits or abuse API endpoints in a manner that degrades service for other users.
- Use the Platform in breach of the acceptable use policy of any AI model provider whose models you access through it.
- Present AI-generated output as human-authored, or as professional legal, medical, or financial advice.
7. AI Models & Provider Policies
The Platform gives you access to AI models operated by third-party providers, including Google, Anthropic, and Mistral AI. Your use of those models is subject to the acceptable use policy and terms of the provider concerned, in addition to these Terms. Where a provider policy is stricter than these Terms, the stricter policy applies. Provider policies may change, and you remain responsible for compliance with the version in force at the time of use.
If you deploy an application that interacts directly with consumers, or that touches legal, medical, or financial subject matter, you are responsible for implementing the additional safeguards those provider policies require. At a minimum you must:
- Clearly disclose to end users that they are interacting with an AI system and not a human.
- State that responses are generated automatically and may be inaccurate or incomplete.
- Not present output as professional advice, and keep a suitably qualified professional in the loop wherever the subject matter is regulated.
- Comply with all applicable law, including the EU AI Act and the GDPR, in the jurisdictions where your application is offered.
You are solely responsible for the applications you build and for the output they produce. Enqualia may suspend or terminate access to any deployment that it reasonably believes breaches a provider policy or this section, where practicable after notice to you.
8. Intellectual Property
The Platform, including its software, design, branding, and documentation, is the intellectual property of Enqualia. You are granted a limited, non-exclusive, non-transferable license to use the Platform in accordance with these Terms.
Any content, data, or API configurations you create through the Platform remain your property. However, you grant Enqualia the right to process and store this data as necessary to provide the service.
9. Data & Privacy
We collect and process only the data essential for the Platform to function. By using the Platform, you consent to this data processing as outlined in our Privacy Policy. We comply with the General Data Protection Regulation (GDPR) and applicable Dutch data protection laws.
10. Availability & Disclaimer
The Platform is provided on an "as is" and "as available" basis. Enqualia does not guarantee uninterrupted, error-free, or secure access to the Platform at all times.
We may perform maintenance, updates, or modifications to the Platform that could temporarily affect availability. We will make reasonable efforts to notify users of planned downtime.
11. Limitation of Liability
To the maximum extent permitted by Dutch law, Enqualia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Platform.
12. Termination
Enqualia reserves the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Platform ceases immediately.
You may delete your account at any time. Upon deletion, your data will be removed in accordance with our Privacy Policy and applicable data retention obligations.
13. Changes to These Terms
Enqualia reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
14. Governing Law & Disputes
These Terms are governed by the laws of the Netherlands. Any disputes arising from or in connection with these Terms shall be submitted to the competent court in the Netherlands.
